European Convention on Human Rights

Weird one here.... currently procrastinating on a law essay reading the 1950 European Convention on Human Rights which has been integrated into UK law since 2000. Seems to me that some bits don't really follow as a "Fundamental freedom";


Article 2 – Right to life

1. Everyone's right to life shall be protected by law. No one shall be deprived of his life intentionally save in the execution of a sentence of a court following his conviction of a crime for which this penalty is provided by law.
2. Deprivation of life shall not be regarded as inflicted in contravention of this article when it results from the use of force which is no more than absolutely necessary:
1. in defence of any person from unlawful violence;
2. in order to effect a lawful arrest or to prevent the escape of a person lawfully detained;
3. in action lawfully taken for the purpose of quelling a riot or insurrection.


Seems a bit ambiguous to me. Everyone has a right to life...apart from those whom we as society feel fit to punish (read punish as take revenge upon) with death. I've never been able to see why we have a right to get up on our high horses and punish anyone. Criminal law should be about protecting society, either by removing threats by imprisonment or rehabilitation (if possible) not playing god.

On top of that it'd seem to ambiguity in situations where the ethical response is to allow or aid in someone's death to prevent suffering, or I would argue in a case of a permanently vegetative state.


Ethics of life and death


Actually while we're on the ethics of life and death, I don't really get the "Right to life" thing anyway. I'm a firm believer that killing someone isn't the evil act, but instead the suffering caused by it. Bear with me here...

If I was to suddenly, without seeing it coming, drop dead here (natural causes, murder, whatever), however you look at it, I would not be losing out all that much. As an atheist I believe there wouldn't be any of me around to miss being alive, so I couldn't possible suffer about it. If I was religious I'd either believe I was going to some sort of heaven, which sounds pretty cushy to me, or I'd be going to hell, which would be cos I'm a sod, so nuts to me anyway. The only real harm done is to the people affected by my death; Id like to think my friends, girlfriend and family would miss me, so they'd suffer as a result. Maybe one day in the future I'll be able to help someone or society as a whole (well here's hoping) so they lose out too.

So I guess what I'm saying isn't that killing someone is right (not that I'm saying its always wrong either), it's just that I think the emphasis can sometimes be misplaced so that an ethical debate can become confused. Also note that if someone's gonna hunt me down and kill me slowly to change my mind, that would have a direct affect on me. Due to our somewhat tenacious nature I would suffer due to my genetic fear of death, and physical suffering from a slow death is obviously noooooo fun.

I think a much more sensible rule would be that everyone has a right to exist (if not necessarily live) without suffering, which is certainly the way I ethic my way through life, but I suppose that throws in the extra complication of just how much suffering counts as suffering. For example this law essay I should be right sucks a bit, I could argue its causing me suffering but not on any significant scale. Everyone has a right to minimal suffering would be perhaps apt.

Article 9 – Freedom of thought, conscience and religion

1. Everyone has the right to freedom of thought, conscience and religion; this right includes freedom to change his religion or belief and freedom, either alone or in community with others and in public or private, to manifest his religion or belief, in worship, teaching, practice and observance.
2. Freedom to manifest one's religion or beliefs shall be subject only to such limitations as are prescribed by law and are necessary in a democratic society in the interests of public safety, for the protection of public order, health or morals, or for the protection of the rights and freedoms of others.



OK so we all know that religion and I aren't the best bedfellows so you could probably see my objection to this. It's not that I object to people believing what they want (++freedom of thought) it's just that giving people the right to practice a religion is dangerous territory. It seems like a free pass to do what you want in the name of religion.

For example we'd all argue that the "National Front" giving racist talks to school kids is wrong. Kids are like intellectual sponges, that may just accept without thinking the nasty, hateful, bigoted racist teachings of such an organisation. I would argue that it is intact tantamount to child abuse to allow such a thing.

Now if we accept that many religious teachings are just as nasty, hateful, bigoted and racist as anything the National Front can come up with it seems to me that giving religion a free pass is a bit bent.

Saying all this I guess (2) above does set that exception, but hey I fancied a rant and it seems a little strange to say practice a religion, unless is messes with "public safety, for the protection of public order, health or morals, or for the protection of the rights and freedoms of others.", isn't it OK to practice anything providing it doesn't mess with that stuff. Meh I've lost where I was going with this one.

Article 12 – Right to marry

Men and women of marriageable age have the right to marry and to found a family, according to the national laws governing the exercise of this right.


Nothing particular wrong with this.. I just don't get why it needs to be written. Surely its no more a "fundamental right" than the "fundamental right" of single people to sleep with random people indiscriminately.

Article 14 – Prohibition of discrimination1

The enjoyment of the rights and freedoms set forth in this Convention shall be secured without discrimination on any ground such as sex, race, colour, language, religion, political or other opinion, national or social origin, association with a national minority, property, birth or other status.


All good apart from the "religion" bit (*the crowd sighs*), and I suppose by the same argument "political or other opinion" . Again seems a little strange. I don't actually know which side of the argument I'm on, but I do find this a little confusing. I'd guess you can discriminate against someone for believing that "Hitler had the right idea" or that "Gays should die". Isn't that an opinion? If you can discriminate by that then surely you can discriminate against anything that's a choice (so religion, political affiliation etc). Has a racist ever managed to sue for getting discriminated against for being a racist... hmmm

Anyway that's my procrastinator's philosophy for the day. Yeah I know.. who am I to get up on my high horse and say anything, but what the hell nobody reads this anyway, apart from potential employees blacklisting me as we speak (So much for "freedom of thought"!). I just like a good rant... so sue me.

Additionally I'd like to add that if I had been able to write that much about my Law essay... id be mostly done now... Sod.

Never Better

Just watched the show "Never Better" on the BBC IPlayer. Tis a comedy about a recovering alcoholic with life. Despite never being a proper alcoholic I feel for the guy. I can see similarities in my own inadequacies in social situation, but I haven't got alcoholism as an excuse. Maybe I should try it.

Recommend the show though... haven't really got it across buts its super cool fun.

My quick guide to understanding code

As in trying to decipher badly documented code (C/C++) written by other people (or yourself);

1) Try using doxygen. Even if the code isn't doxytagged it's visualisation tools can still help you get a grip. Plus being able to follow hyperlinks to other classes in source is useful.

2) Codeviz looks quite handy.. havent had a chance to use it yet.

3) Kill the person who wrote the code. As the great quote says;
"Always code as if the guy who ends up maintaining your code will be a violent psychopath who knows where you live."

Linux has come of age

We all know that it has been the case that the image of Linux is one of impenetrable command line interfaces for geektastic individuals. Not that there was anything wrong with that but it did put of the mainstream. I feel that Linux has come of age... why you ask?

My Mum uses Linux.. Yep hard to believe it but its true.. and she seems to be getting on fine with our penguin friend. In her words;

"Everything works so efficiently and haven't lost anything yet - I think ! Just wish I had more time to spend on it and explore."


I'm very proud of her for not being scared of something new but it also proves that Linux (Ubuntu) is ready for the mainstream.

Mac's Steve Jobs unfairly spazzed out at my favourite blogger Violet Blue. Our lovely blogger was the poster child of iTunes podcasts at the beginning and still hits top ten.

I lightly touched his arm and said "hi". He looked at me, and I blushingly asked if it would be okay for me to ask if I could take a picture with him. I didn't say my name or anything else, I was just a girl. He told me curtly, flatly that I was rude. And turned his back to me. The small circle of people around him sniggered. That woman you see actually snort-laughed at me, and rolled her eyes.


See! I told you all Mac were evil. 666 end of the world and all that. Maybe I can email VB and try and convince her to ditch the Mac an use a PC, and open source. Turn away from the dark side my child. My god this is a geeky paragraph.
